(1) Any suit or legal proceeding instituted or which but for the passing or this Act have been instituted by or against the Corporation or the Commissioner under the '[Kolkata] Municipal Act, 1951, may be continued or instituted by lhe CorporaLion or the Municipal Commissioner, as the case may be, constituted or appointed under this Acl. (2) For the purposes ofsuchsuil or legal proceeding and of all matters incidental thereto, the powers and duties of the Corporation and of the Commissioner under the '[Kolkata] Municipal Acl, 1951, shall vest in the Corporation and the Municipal Commissioner constituted and appointed respectively under Lhis Acl, and when any action has been taken under the 'LKolkata] Municipal Act, 1951, such action shall be deemed to have been taken by the corresponding authority under lhal Acl, and lhe corresponding provisions of this Act shall be deemed to have been complied wilh.
