(1) Any owner of any land or building may, if he is prevented by the occupier thereof from complying with any provision or Lhis Aci or lhe rules or lhe regulations made thereunder or any requirement under any such provision in respect of such land or building, apply to the Court of Small Causes having jurisdiction within Lhe time fixed for compliance with such provision or requirement, and thereupon such owner shall nol be liable for bis failure to comply wilh such provision or requirement within lhe time fixed for such compliance. (2) On receipt of any application under sub-seciion (1), lhe Couriof Small Causes may make a written order requiring the occupicr of the land or lhe building, as the case may be, to afford all reasonable facilities to the owner for complying with Ihe provision or the requirement as aforesaid, and may also, if il thinks ftl, direct that the costs of such application and order shall be paid by the occupier. (3) The occupier shall, within cighl days from lhe dale of any order under sub- section (2), afford all reasonable facilities to the owner in compliance wilh such order. In Lhe event of any continued refusal by the occupier to do so, the owner shall be discharged, during the continuance of such refusal, from any liability which he would otherwise have incurred by reason or his failure lo comply wilh lhe provision or the requirement as aforesaid. 864 The Kolkata Municipul Corporalion Aci, 1980.
