(i) No person shall wilfully or negligently cause or suffer any water- filling, which he is liable lo maintain,— (a) io be or remain so oul of order or so in need of repair, or (b) lo be or remain so constructed or adapted or lo be so used, lhai the water supplied lo him by lhe Corporation is or is likely lo be wasted, misused or unduly consumed, or contaminated before use, or lhai foul air or any impure mailer is likely lo return inlo any pipe belonging io, or connected wiih, a main belonging io the Corporalion. (2) If any watcr-fiiting which any person is liable to maintain is in such The Kolkata Municipal Corporalion Acl. 1980. <715 LIX of 1980.] condition or is so conslrucled or adapted as aforesaid, lhe Municipal Commissioner, without prejudice to his right to proceed against Lhe person under any oilier provision of this Act, may require that person to carry oul any necessary repairs or alterations and, if he fails lo do so wiihin forty-eight hours, '[may cause to be carried oul] lhe work and recover from him the expenses reasonably incurred by hiin in so doing as an arrear of lax.
