Cessation of office of Mayor, Chairperson, Deputy Mayor and Vice Chairperson – (1). The Mayor or the Chairperson may resign his office by writing under his hand addressed to the Deputy Commissioner. (2) The Deputy Mayor or the Vice-Chairperson may resign his office by writing under his hand addressed to the Mayor or the Chairperson as the case may be. (3) Every resignation under sub-section (1) and (2) shall take effect on the expiry of seven days from the date of such resignation, unless within the said period of seven days they withdraw such resignation by writing under their hand addressed to the Deputy Commissioner or the Mayor or the Chairperson, as the case may be. (4). The Deputy Mayor or the Vice-Chairperson, as the case may be, shall cease to hold office as such if they cease to be a Councillor. (5). The Deputy Mayor, and the Vice-Chairperson may be removed from office by a resolution of no confidence motion carried by a majority of total number of councillors at a special meeting to be called for this purpose in the manner prescribed upon a requisition made in writing by not less than one third of the total number of elected councillors, and the procedure for carrying out no-confidence motion shall be such as may be prescribed: Provided that no-confidence motion shall not be brought within one year of taking charge of the office: Provided further that no-confidence motion shall not be brought within a period of two years of first no- confidence motion: Provided also that a no-confidence motion shall not be brought where the remaining term of office is less than six months.
