A prisoner shall not be eligible for shifting to semi-open air prison or open air prison who, - (a) is a hardcore prisoner; or (b) is below the age of 25 years on the date of submission of application for semi-open air prison or open air prison; or (c) is not fit to do work; or (d) is an under trial prisoner, detenue or a civil prisoner; or (e) is charge sheeted or convicted in more than one case; or (f) is punished for a major prison offence in the last three years; or (g) is not a permanent resident or whose family member does not have a permanent residence in the State; or (h) has not availed any parole/ furlough in the last three years; or (i) has escaped or attempted to escape from prison, police custody or any other lawful custody at any point of time; or (j) do not have a family; or (k) is convicted by a court having jurisdiction outside the State or by a Military Court; or (l) is convicted in connection with political agitation or political movement etc; or (m) is convicted in cases relating to terrorist and disruptive activities, immoral trafficking, supply or smuggling of narcotic drugs and psychotropic substances or for any activities jeopardizing the security of the State; or (n) is suffering from any infectious or contagious disease or is mentally sick; or (o) in the opinion of the Superintendent is unfit to be shifted to the semi-open air prison or open air prison.
