(1) The Government shall provide accommodation in prisons constructed and regulated in such manner as to comply with the prescriptions under the Act and these rules in respect of the separation of prisoners. (2) In a prison housing female as well as male prisoners, the females shall be imprisoned in separate buildings or separate parts of the same building, in such a manner as to prevent their seeing or conversing with or holding any social interaction with the male prisoners. (EXTRA.), DEC. 30, 2022 (PAUS. 9, 1944 SAKA) 1217 (3) In a prison where prisoners under the age of twenty-one years are confined, adequate means shall be provided for separating them altogether from other prisoners. (4) Undertrial prisoners shall, as far as practicable, be kept apart from convicts. For administrative purposes, convict officers may be deputed in barracks wherein under trials are confined. (5) Civil prisoners shall, as far as practicable, be kept apart from criminal prisoners. (6) Prisoners classified under different security categories shall be kept separate from each other. (7) Lesbian, Gay, Bisexual, Transgender, Queer prisoners shall be kept separately in male and female enclosures respectively based on their medical examination on recommendation of the medical officer of the prison. Separate accommodation including toilet/bathroom facilities shall be provided for them. NOTE:- Instructions or orders issued by the Government or the Director General in accordance with the Transgender Persons (Protection of Rights) Act, 2019 (Central Act 40 of 2019) shall be read as part and parcel of these rules and applicable as such. (8) When in any prison, only one prisoner is lodged under any category, such prisoner may, if he so desires, be permitted to associate with prisoners of another class: Provided that the category, with which such prisoner is permitted to associate, shall be determined by the Superintendent who shall ensure that the provisions of the Act are not in any case infringed by the permission so accorded. (9) In a prison where number of toilets and feeding and bathing platforms is not sufficient to keep the classes completely apart at parades, appropriate arrangements for separation shall be made after giving pragmatic consideration to circumstances. 1218 HARYANA GOVT.
