(1) On and after the day on which the notice of a scheme has been published under section 70, the Development Authority may, after giving the prescribed notice,— (a) remove, pull down, or alter any building or other work in the area included in the scheme which contravenes the scheme or in the erection of which or carrying out of which, any provision of the scheme has not been complied with; (b) execute any work which it is the duty of any person to execute under the scheme, in any case where it appears to the concerned Authority that delay in the execution of the work would prejudice the efficient operation of the scheme. (2) Any expenses incurred by the Development Authority under this section may be recovered from the person in default or from the owner of the existing plot in the manner provided for the recovery of sums due to the Authority under the provisions of this Act. (3) If any action proposed to be taken under sub-section (1) of this section by the Development Authority is questioned, the matter shall be referred to the State Government or any officer authorised by the State Government in this behalf; and the decision of the State Government or of the officer, as the case may be, shall be final and binding on all persons.
