No person shall, without, or otherwise than in conformity with the terms of, a licence granted by the Commissioner in this behalf or without payment of such fees as may be determined by the Corporation, keep open any theatre, circus, cinema-house, dancing-hall or similar other place of public resort, recreation or amusement for any gainful purpose: Provided that the provisions of this section shall not apply to any private performance, or performance for philanthropic purpose, in any such place as aforesaid.
