Without prejudice to the provisions of sub- General section (2) of section 4, if the State Government is satisfied Power co that any land within Durgapur is needed for any public pur- ia2 e for pose, the State Government may, subject to payment of public compensation for the land, acquire such land in accordance purpose. with the provisions of any law for the time being in force: Provided that in determining the amount of compensation payable for any such land the following .principles shall be taken into consideration,— (c) the value of the land shall not in any case, exceed its market-value as on the 1st day of January, 1955, and (ii) no such sum as is referred to in sub-section (2) of of 1894. section 23 of the Land Acquisition Act, 1894 shall be included in the compensation.
