(1) Any person who undertaken or carries out the ?nat . ty. development of any site or erects any building in conDavcn-n "Zcl tion of the provisions of section 5 shall, without prejudice pravimis to any action that may be taken under section 7, be punish- sanction. able with fine which may extend to one thousand rupees. (2) Any person who, without lawful excuse, obstructs the Authority or person or officer, as the case may be, in the exercise of the powers conferred upon it or him, under sub- _ section (1) or sub-section (2) of section 9 shall be punishable with fine which may extend to five hundred rupees. (3) No Court inferior to that of a magistrate of the first class shall try an offence punishable under this section. (4) No prosecution for any offence punishable under this section shall be instituted except with the previous sanction of the State Government or an officer authorised by the State Government in this behalf.
