(1) No court inferior to that of a Presidency Magistrate or a Cognizance Magistrate of the first class shall try any offence under this Act. of offences. 5 of 1898. (2) For the purposes of the Code of Criminal Procedure, 1898, every offence under this Act shall be deemed to be non-cognizable. (3) No prosecution shall be instituted under this Act without the previous sanction of the Registrar. (4) Notwithstanding anything contained in the Code of Criminal Procedure, 1898, any offence committed under section 403 of the Indian as of 1860.
