(2) Upon rcceipL of any such complaint, lhe Municipal Magistrate, after making such inquiry us he considers necessary, may, if he thinks fit, by a written order, direct the person responsible for such nuisance or the owner of the land or lhe building on which such nuisance exists lo lake, within such period as may be specified in the order, such measures for abating, preventing, removing or remedying sucli nuisance as may appear to the Municipal Magistrate to be practicable and reasonable and may direct the Municipal Commissioner to enforce any of the provisions of this Aci or lhe rules or the regulations made thereunder for prevention of such nuisance. The Municipal Magistrate may further direct the person held reasponsible for the nuisance to pay to llie complainant such resonable cost of the complaint (including compensation for loss of lime in prosecuting such complaint) as lhe Municipal Magistrate may determine: Provided thai where, in the opinion of the Municipal Magistrate, immediate action to prevent Ihe nuisance is necessary, he may dispense wiih the inquiry and make forth wiih such order as he considers necessary, (3) ir any person responsible for any nuisance or any owner of any land or building on which any nuisance exists fails lo comply with any order under sub- section (2) wiihin the period specified in the order, the Municipal Commissioner may, on lhe expiry of such period, proceed to lake measures in accordance wiih the order, or may take such other measures lo abate, prevent, remove or remedy Ihe nuisance as he may consider necessary and the cost of any such measures shall be recovered from such person or such owner, as lhe case may be.
