If, in any case, any person, who is summoned to appear before a Municipal Magistrate to answer any charge or an offence under this Acl or the rules or the regulations made thereunder, fails to appear on the date and at the time and the place mentioned in the summons issued in this behalf or on any subsequent date Lo which the hearing or such case is adjourned, the Municipal Magistrate may, ir— (a) service or the summons is, to his satisfaction, proved lo have been effected, and (b) no sufficient cause is shown for non-appearance of such person, hear and determine such case in the absence of such person.
