(1) The Slate Government may appoint one or more Judicial Magistrates of first class for lhe trial of offences against— (a) this Aci, and (b) the rules or the regulations made thereunder, and may prescribe the time and Lhe place at which such Magistrate or Magistrates shall sit for lhe conduct of business. Every such Magistrate shall exercise all other powers and discharge all other functions of a Magistrate as provided in lhis ACL. (2) Any Magistrate appointed under sub-seclion (I) shall be called Municipal Magistrate and shall, when functioning within the Presidency- town of '[Kolkaia] or wiihin lhe limits oflhe Port of '[Kolkaia], be deemed to be a Metropolitan Magistrate for the purposes of the Code of Criminal Procedure, 1973. (3) A Municipal Mugisiniie shall, if he is stipendiary, be paid by the Slate Government such salary, pension, leave and other allowances as il may, from lime io lime, determine. (4) The Corporalion shall pay lo the State Government out of the Municipal Fund any amouni paid by the Stale Government on account of salary, pension, leave and olher allowance of a Municipal Magi sir ale under sub-section (2) together with the cost of establishment of such Magistrate and all other incidental charges in connection with such establishment.
