(I) Whenever the Municipal Commissioner is unable under Procedure . , ■ <. whcn section 536 to acquire by agreement any immovable properly or any immovable easement affecting any immovable property vested in the Corporalion or whenever any immovable properly or any easement affecting any a en ui red by immovable property vested in the Corporation is required for the purpose of this Acl, lhe State Government may, in ils discretion, upon application of the Municipal Commissioner, made wiih Lhe approval of lhc Mayor- in-Council and subjeci to other provisions of Lhis Act, order proceedings tobelaken for acquiring the same on behalf or lhe Corporation, as if such properly or easement were land needed for public purpose within the I of iss>4. meaning oflhe Land Acquisition Act, 1894. (2) Whenever an application is made under sub-section (1) for lhe acquisition of land Tor lhe purpose of providing a new sireel or For widening or improving an existing street, it shall be lawful Tor the Municipal Commissioner lo apply for the acquisition of such additional land immediately adjoining the land lo be occupied by such new street or existing street as is required for the siies of buildings to be erected on either side of the sireel, and such additional land shall be deemed lu be required for the purposes of this Acl.
