(1) If any place is, in the opinion of Municipal Commissioner, for want of sufficient repair or proteciion or enclosure or owing to some work being carried out thereupon, dangerous or causing inconvenience to passengers along a slreel or to other persons including the owner or the occupicr of such placc who have legal access thereto or to the neighbourhood thereof, the Municipal Commissioner may, by a noiice in writing, require the owner or the occupier of such place to repair, protect or enclosc the same or lo take such other step as may appear to the Municipal Commissioner lo be necessary in order to prevent the danger or inconvenience arising therefrom within sucii period as may he specified in the noiice, (Part VI,—Town Platiniiig, Land and Land Use Controls— Chapter XXI.—Streets and public places.—H. (d) placc and maintain— (i) electric wires Tor the purpose of lighting such lumps under, over, along or across, and (ii) posts, poles, standards, slays, struts, brackets and olher contrivances Tor carrying, suspending or supporting lamps or electric wires in or upon, any immovable properly without being liable to any claim for compensation thereof: Provided that such wires, posls, poles, standards, stays, siaits, brackets and other contrivances shall be so placed as to occasion llie leasl practicable inconvenicnce or nuisance lo any person; Provided further that the Corporation may, Tor carrying, suspending or supporting any lumps or dearie wires, enter into an agreement wiih any firm or company for using, on terms and conditions mutually agreed upon, any posts, poles or standards crected and maintained by such firm or company. (2) Notwithstanding anything contained in the Indian Electricity Acl, 1910, lhe Corporation shall not be liable, except on the ground of negligence, to any claim for compensation for any damage, detriment, inconvenicnce or nuisance caused by il or by any one employed by it, in the excrcise of any of the powers conferred by sub-section (1). (3) The Municipal Commissioner may, on an application from the owner or owners of a private sireel, make arrangements for lhe lighting of such sireels on such terms as lhe Mayor-in- Council may specify and upon such arrangemenls, shall, in respect of such street, excrcise all the powers conferred by this scction.
