(1) The Municipal Commissioner may, by a written nolice, require lhe owner or the occupicr of any premises contiguous io or in front of or connected with any wall, fence, rail, post, slep, booth or oilier structure or fixture, [he ereclion or the selling up of which would be unlawful after the coming into force of scclion 371, to remove sueh wall, fence, rail, post, step, booth or olher structure or fixture, crceted or set up before the coming into force of that section, (2) If in any case lhe ereclion or the setting up of any structure or fixture us aforesaid shall have been lawful, compensation shall be paid by the Municipal Commissioner io every person who sustains loss or damage by the removal or such structure or fixture.
