(1) ir any person lays out or makes any slreel otherwise than in conformity with the provisions of seclion 365, llic Municipal Commissioner may, whether or nol such person is prosecuted under this Acl, by a written noiice,— (a) require him io show cause, by a wrilien statement signed by him and sent to the Municipal Commissioner on or before such date as may be specified in lhe notice, why such street should nol he altered to lhe satisfaction of the Municipal Commissioner or if such alteration is impracticable, why such street should not be demolished; or (b) ' require him to appear before ihe Municipal Commissioner either personally or by n duly authorized agent on such day and at such lime and place as may be specified in lhe noticc and show cause as aforesaid. (2) ]f any person on whom a noiice is served under sub-scclion (1) fails to show cause lo lhe satisfaction of the Municipal Commissioner why such slreel should nol be so altered or demolished, the Municipal Commissioner may pass an order directing the alteration or demolition of such slreel. 18Sce fool-note 2 on pujjc 573, tunc.
