(1) Before utilizing, selling or otherwise disposing of any land Layout under section 364, the owner thereof shall send to the Municipal plnils- Commissioner a wrilien application wilh a layout plan of the land showing the following particulars:— (a) lhe plots into which Lhe land is proposed to be divided for lhe erection of buildings thereon and the purpose or purposes for which such buildings are lo be used; [Wcsl Ben. (b) the reservation or allotment of any site for any sireel, open space, park, recreation ground, school, markel or any oilier public purpose; (c) lhe intended level, direction and widLh of sireel or streets, including footpaths; (d) the regular line of street or sireels; (e) lhe arrangements io be made for levelling, paving, mcialling, flagging, channelling, sewering, draining, conserving and lighting sircel or sireels, (2) The provisions of ihis Aci and lhe rules and lhc regulations made thereunder as to the widlhs of public streets, including footpaths, and the height of buildings abutting thereon shall apply in the case of streets referred lo in sub- section (1), and all the particulars of a layout plan, referred to in lhat sub-seclion, shall be subject io the approval of the Mayor-in-Council. (3) Within sixty days of rcceipl or any application under sub-seclion (1), the Mayor-in-Council shall either accord approval lo the layout plan on such conditions as il may think Tit or disallow il or ask for further information with respect to il, (4) Such approval shall be refused,— (a) if the particulars shown in the layout plan arc in conflict wiih any arrangements which have been made or which arc. in the opinion of Lhe Mayor-in-Council, likely io be made for carrying oul any general scheme of development of '[Kolkaia], whether or nol such schcmc is contained in lhe development plan or the development scheme of any authority under any law in force for the time being; (b) if the layout plan does not conform to the provisions of'this AcL and Lhe rules and the regulations made Lhereunder; or (e) if any sireel proposed in lhe layoui plan is nol so designed as Lo connect il at one end with a street which is already open. (5) No person shall utiLize, sell or otherwise deal with any land or layout or make any new street without or otherwise lhan in conformity with the orders or lhe Mayor-in-Council and, if further information is asked for, no step shall be laken to utilize, sell or otherwise deal with the land or io lay out or make the sireel until an order has been passed by Lhe Mayor-in-Council upon receipt of such information: The Kolkata Municipal Corporation Act, 1980, 757 Alien lion or demolition of slreel made in breach of seclion
