(1) The Mayor-in-Council shall constitute a Municipal Sireels Municipal Technical Committee with the Municipal Commissioner as its Chairman Technical and another officer of (he Corporalion as its convener. Commiuce. (2) In addition to the Chairman and the convener, (he Committee shall have five other members of whom— (a) one shall be a nominee or lhc '[Kolkaia] Metropolitan Development Authority, (b) one shall be a nominee of Lhe Commissioner or Police, '[Kolkaia], and (c) three shall be nominated by the State Government from the concerned departments of the State Government or statutory bodies. (3) The Commiuce shall meet at least once in a month. (4) The Committee shall, in order to secure the expeditious, convenient and sare movement or traffic, including pedestrian traffic, and suitable and adequaie parking facilities on and off lhe public streets, and with due regard to— (a) the desirability of securing and maintaining reasonable access to premises, (b) the effect on the amenities of any localily affected, and ■ [Wcsl Ben. Council, aid, advise and assist (he Mayor-in-Council in the following mailers:— (i) classification of public streets, (ii) prescription of regular line of slreel, (iii) regulation of abutting land uses, (iv) designation of on-slreel parking areas, (v) allocation of rights of way for underground utilities, (vi) placement or street furniture, (vii) placement of authorized fixtures on streels, such as electric and telegraph poles, post boxes, telephone junction boxes, sheds for trams and buses, milk booths, and ihc like, (viii) opening of new public streets, (ix) permanent closure of existing public streets, and (x) any other mailer lhal may be referred to it by the Mayor-in-Council. (5) The Committee shall, while making any recommendation Lo the Mayor-in-Council on any mailer conform to the development plan or lhe development scheme prepared by any competent authority under any other law in force for ihc lime being and shall take into account such plans, proposals, surveys, studies and supporting technical data on such mailer as might be in lhe possession of ihc Corporation or the '[Kolkaia] Metropolitan Development Authority or the Commissioner of Police, '[Kolkata] or any department of the Slale Government or any such competent authority: Provided that nothing in this section shall be deemed to limit the power of the Corporation lo prepare its own development plan or scheme or pursue any programme which is not covered by and is not in conflict with a plan, scheme or programme of any other authority under any other law in force for the time being. (6) The Commiliee may call Tor any paper, document, map or data from the Corporation or the '[Kolkaia] Metropolitan Development Authority or Ihe Commissioner of Police, '[Kolkaia] or any department of the State Government or any competent authority and thereupon it shall be its or his duly lo comply with such requisition. 7V,v Kolkaia Municipal Corporation Act, 1980. 747 Classification or public sircels. (7) The Mayor-in-Council shall consider Ihc recommendations of Lhe CommiLLee and lake such decision thereon as it thinks fit afler taking inlo account plans, proposals, surveys, studies, schcmcs and programmes, if any, referred lo in sub-section (5). (8) If any doubt arises as lo whether ill e decision taken under sub-section (7) is in conflict with any plan, scheme or programme of any competent authority under any oiher law in force for Lhe time being, lhe matter shall be referred to Lhe State Government whose decision shall be final.
