(I) No person shall construct a cesspool—- (a) beneath any pan of any building or within fifteen meters of any lank, reservoir, water-eonr.se or well; or (b) upon any site or in any position in '[Kolkaia] which hits not been approved by lhe Municipal Commissioner; or (c) upon any site or in any position oulside '[Kolkaia] which has noi been so approved and is situated wilhin ninety metres of any reservoir used for the storage of wholesome water to be supplied to '[Kolkata], (2) The Municipal Commissioner may, al any time by written notice, require any person within whose premises any cesspool is constructed in contravention of .sub-section (1) to remove such cesspool or lo fill it up wilh such maierial as may be approved by him.
