The Municipal Commissioner may, i f he considers accessary so lo do, require the occupier, instead of llie owner, of any premises to carry oul any work which might otherwise be required to be carried oul by such owner under lhe provisions of Ihis Act and thereupon such occupier shall be bound to carry oul such work: Provided that except in die case or aiiy special agreement to thu contrary, such occupier may dcducl the amouni or (he expenses reasonably incurred or paid by him in respeci of such work rrom any rent payable lo the owner or may recover the same from liini by an order of a court or competent jurisdiction, '
