Where a house-drain contieciing any premises with a municipal drain is sufficient for lhe effectual drainage of sucii premises and is otherwise unobjectionable but is not, in Lhc opinion of Lhc Municipal Commissioner, ad op Led to the general system of drainage in '[Kolkata], he may, by writLcn notice adddresscd lo the owner of the premises, direct— (a) thai such house-drain be closed, discontinued or destroyed and that any work necessary for (hai purpose be done; or (b) lhai sueh house-drain shall, from such dale as may be specified in lhe noiicc in this behalf", be used for sewage, offensive mailer and polluted waler only or for rain water and unpolluted subsoil water only: Provided lhai— (i) no housedrain may be closed, discontinued or destroyed underclausc (a) cxcept on condition of his providing another drain equally effectual Tor the drainage or the premises and communicating with any municipal drain which he thinks fit; and (ii) the expenses of the construction of any drain so provided by the Corporation and of any work done under clausc (a) may be paid out of lhe Municipal Fund.
