(1) The Council may, without prejudice to the provisions of sub-section (2), by a majority of not less than two-thirds of its total members present and voting, at any time remove a member of the Council if it is satisfied that for any reason the continuance of that member in the Council is against public interest or is prejudicial to the interest of the Council. (2) The Council may remove any member of the Council other than ex-officio members and shall declare his office as vacant, if he:— (a) becomes subject to any of the disqualifications specified under section 9; or (b) refuses to act or becomes incapable of acting as a member; or (c) has absented himself from three consecutive meetings of the Council without the permission of the Council; or (d) is absent for being out of India for a period exceeding twelve consecutive months; or (e) has abused the position of the President, the Vice- President or a member, as the case may be, as to render his or her continuance in the office detrimental to the public interest: Provided that no such declaration shall be made under this sub-section unless a reasonable opportunity of being heard is given to the member concerned. (3) Any member aggrieved by a declaration under sub-section (2) may prefer an appeal to the State Government within ninety days from the date of such declaration and the decision of the State Government thereon shall be final.
