When a person suffering or certified by a duly qualified medical practitioner to be suffering from cholera, plague, small-pox or any other infectious disease that may be notified in this behalf by the State Government is,- (a) without proper lodging or accommodation, or (b) living in sarai or other public hostel, or (c) living in a room or house which he neither owns nor is otherwise entitled to occupy, or (d) lodged in a room or set of apartments occupied by more than one family and any of the occupiers object to his continuing to lodge therein, The [Municipality]2 may, on the advice of a medical officer of a rank not inferior to that of an assistant surgeon, remove the patient to a hospital or place at which person suffering from such disease are received for medical treatment and may do anything necessary for such removal. Penalty for acts done by persons suffering from certain disorders
