Added. by section 16 (b) ibid. [The Uttar Pradesh [Municipal Corporation]4 Act, 1959] [Section 50-51] (c) to question the legality of any action taken or of any decision given by the Nirvachan Adhikari (Returning Officer) or by any other person appointed under this Act in connection with an election.]2 Notification for election and vacancy [50- (1) A general election shall be held for the purpose of constituting or reconstituting a Corporation. (2) For the said purpose, the State Government shall, by notification published in the official Gazette, on such date as may be recommended by the 309 State Election Commission, call upon all wards in the City to elect Subheads and the Nagar Pramukh in accordance with the provisions of this Act and of the rules and orders made there under. (3) If a casual vacancy occurs in the office of Nagar Pramukh, Upa Nagar Pramukh or a Sabhadad owing to death or resignation or any other cause, such officer or seat, as the case may be, shall be declared vacant by the State Government by notification published in the official Gazette. (4) When an office or seat has been declared vacant, the State Election Commission shall, by a notification in the official Gazette, call upon the ward concerned or, as the case may be, the Sabhashads, to elect a person for the purpose of filling the vacancy so caused in accordance with the provisions of this Act and of the rules and orders made thereunder before such date as any be specified in the notification.]5 Executive Committee Constitution and term of Executive Committee 51- (1) The Executive Committee shall consist of- (a) the [Nagar Pramukh]1 who shall be ex-officio Chairman of the Executive Committee; and (b) twelve persons to be elected by the [Corporation]4 out of Sabhashads [xxx]3.
