Every officer or servant of [the Board or a Committee]4 shall be deemed to be a public servant within the meaning of section 21 of the Indian Penal Code. CHAPTER V Establishment of the Board 3[Establishment of the Board 26-A (1) The State Government shall by notification in the Gazette, and with effect from a date to be specified therein, constitute a Board by the name of the State 96 Agricultural Produce Market Board with its head office at Lucknow. (2) The Board shall be a body corporate by the said name having perpetual succession and a common seal and any Sue or the sued by the said name and acquire, hold and dispose of property and enter Into contracts. (3) The Board shall for all purposes be deemed to be a local authority. Constitution of the Board 26-B (1) The Board shall consist of a Chairman appointed by the State Government besides the following other members namely :_ [(a) the Agriculture Production Commissioner, Uttar Pradesh if he is not the Chairman;]5 (b) the Secretary to the State Government in the Finance Department; (c) the Secretary to the State Government in the Food and Civil Supplies Department; [(d) the Secretary to the State Government in the Agriculture Department or where there is no separate Secretary for the said Department, then the Special Secretary or Joint Secretary, as the case may be, in that Department;]6 (e) the Registrar, Co-operative Societies, Uttar Pradesh ; (f) the Director of Agriculture, Uttar Pradesh ; [(f-1) the .Agricultural Marketing Adviser to the Government of India; (f-2) the Director, Horticulture and-Fruit Utilization, Uttar Pradesh.; (f-3) the State Agricultural Marketing Officer, Uttar Pradesh;
