(1) Whoever dcfaces any propcrty in public vicw by writing or Penoltyior marking with ink, chalk, paint or any other n~aterial, except Tor the "c"ccn'cnl oi pn~pcrty. purposc of indicating the name and address of tllc owner or occupier of such property, shall be punishable with imprisonment for n tern1 which nlay extend to six rnontlis or with fine which may extend to one thousand rupees or with both. . ( 2 ) Whcrc any orfence eomlnitted under sub-sccrion ( I ) is Tor the benefit oTsb~ne other person or a company or othcr hcdy corporate or an associarion of persons (whcthcr incorporated or not ), then, such othcr person and every presidcnt, chairman. director, partncr. manager, secretary, agent or any other officer or person conccrned with the management rhcrcoF, as the cnsc lnay be, shall, unless he proves that thc offence was committed without his knowledge or consent, bc dcc~ned to be guilty ol such offcnce.
