(1) The State Government shall lay, in each financial year during the Budget Session, before the State Legislature, a State Electricity Distribution Management Statement on the measures taken by the State Government in relation to electricity distribution in the State including, in the areas of long-term planning, consumer protection, regulatory compliance, corporate governance, financial restructuring of the State Distribution Licensee, so as to bring about the operational and financial viability of the State Distribution Licensee, on sustainable basis and in particular it shall comprise of the following:- (a) State Electricity Distribution Strategy Statement mentioning the targets for the key performance indicators and laying down the policies and strategies of the State Government for achieving the targets set for the key performance indicators, for the ensuing financial year, relating to the 4 conditions or provisions referred to in section 4, section 5, section 6, section 7 and section 9, and description of other activities which have potential implications on financial and operational turnaround of the State Distribution licensees; (b) time bound action plan, on long-term, medium term and short-term basis including,- (i) activities to achieve targets for key performance indicators; (ii) monitoring mechanism to ensure achievements of targets for key performance indicators; (iii) feedback loop for in/ mid-course corrections; and (iv) such other actions as may be required to meet the obligations cast under this Act on the State Government to achieve the objectives of this Act: Provided that the Action plan shall contain steps, including disciplinary action against defaulting officers, for eliminating/ minimizing deviation in actual performance and targets for key performance indicators. (c) State Electricity Distribution Performance Statement laying down an assessment of compliance, by the State Electricity Distribution Licensees or the State Government, as the case may be, with the conditions or provisions referred to in sections 4, section 5, section 6, section 7 and section 9 and vis-�-vis the key performance indicators. (2) The State Electricity Distribution Management Statement shall be in such form as may be prescribed. (3) The State Electricity Distribution Management Statement shall be without prejudice to any consequences to which the State Distribution Licensee may be liable under the Electricity Act, in particular, the timeline referred to in section 55 of the said 5Act and any orders and directions of the authorities in relation to any of the requirements under the said Act: Provided that nothing in this section shall imply relaxation of any requirement under the Electricity Act.
