(1) The ChiefCommissioner shall not be removed from his office except by an order by the Government on the ground of proven misbehavior or incapability after an inquiry as prescribed by the Government in which the Chief Commissioner had been informed ofthe charges against him and given a reasonable opportunity ofbeing heard in respect of such charges. (2) The Government may, by rules, regulate the procedure for the inquiry of misbehavior or incapability ofthe Chief Commissioner referred to in sub— section (1). (3) Notwithstanding anything contained in sub-section (2), the Government may, by order, remove the Chief Commissioner from his office, if he —— (a) is, or at any time has been, adjudged an insolvent; or PUNJAB GOVT. (EXTRA), JULY 17, 2018 85 (b) (C) (d) (e) (1‘) (ASAR 26, 1940 SAKA) has engaged at any time, during his term ofoffice, in any paid employment; or has been convicted of an offence which, in the opinion of the Government, involves moral turpitude; or has acquired such financial or other interest as is likely to affect prejudicially his functions as ChiefCommissioner; or has so abused his position as to render his continuance in office prejudicial to the public interest; or has become physically or mentally incapable ofacting as Chief Commissioner.
