Opium recovered by Head-Constable - No independent person present - Prosecu- tion not to the discredited. There being no provision of law requiring the attendance of any independent witness at the time of search of the person of a suspect, the recovery proceeding cannot be held to be suspicious or unreliable simply because no independent witness was opted to join the raiding party. At best it would be suspicious circumstance which would require the court to scrutinize the evidence carefully, but that by itself cannot warrant to discredit the prosecution case.
