(1) The Government shall by notification in the Official Gazette, establish a Board for the territory by the name of “the Puducherry Board of Secondary and Higher Secondary Education” (2) The Board shall be a body corporate by the name mentioned in sub-section (1) and shall have a perpetual succession and a common seal, and shall have power to acquire, hold and dispose of property and to enter into contracts, and may by the said name sue and be sued. (3) The Board shall be open to persons of either sex and of whatever race, creed, caste or class and it shall not be lawful for the Board to adopt or impose on any person, any test whatsoever of religious belief or profession in order to entitle him to be admitted to its privileges, as a teacher or student or to hold any office therein, or to receive certificate thereof: Provided that nothing in this section shall be deemed to prevent the Board from making special provisions for weaker sections of the people and, in particular, of the Scheduled Castes and Scheduled Tribes. (4) French nationals of Indian origin who have been permitted long-term residence in the Territory under the provisions of Treaty of Cession shall also be eligible for admission to the privileges of the Board. 388 Explanation.- Treaty of Cession has the meaning assigned to it in the Puducherry (Administration) Act, 1962 (Central Act 49 of 1962).
