An order passed by the Commissioner under Section 45, Section 46 order in, , ! OF Section 47 or by the Government und,er Section 50 shall not be called in eases- question in any Court except on the ground - 1 (a) that the Commissioner or the ~overnment, as the case may be, had not followed the procedure laid down in sub-section (1 ), sub- section (2), or sub-section(4) of'section 49 orBectibn 50, as the . . case may be; or (b) that there was no, material before the Commissioner or t,he Government, as , the , case may, be, upon which he or it could, , . , . have based his order; or ' . . , .
