(1) In the case of any rule, regulation or order made or sanctioned by interested the Government under an authority confer& 6y this Act and requiring the may seek lo annual. public or a particular class of persons to perform some duty or act, or to conduct reverse or or order themselves or those under their control in a manner therein described, aller any it shall be competent for any person interested to apply to the Government by rule, reaulalion memorial given to the Secretary to the ~wernment to annul, reverse or alter order. the rule, regulation or order aforesaid on the ground of its being unlawfcrl, oppressive or unreasonable. (2) After such an application as aforesaid and the rejection thereof wholly or in part or after the lapse of four months without an answer to such application or a decision thereon published by the Government, it shall be competent for the person interested, deeming the rule, regulation or order to be coritrary to law, to institute a suit against the Govemment for a declaration that Ihe rule, regulation or order is unlawful either wholly or in part. (3) The decision in a suit instituted under sub-section (2) shall be subject to appeal, and a rule or order finally adjudged to be unlawful shall t.-y the Government be annulled or reversed or so altered as to make it conformable to law.
