Vacation of office by existing Councillors, Commissioners and office bearers :– Notwithstanding anything contained in Chapter IV of this Act, it shall be lawful for the State Government to direct that the term of office of the Chairperson Vice-Chairperson or Councillors, holding offices under the Madras District Municipalities Act, 1920 (Madras Act V of 1920), or the Chairperson, Vice-Chairperson or the Commissioner holding office under the Bihar and Orissa Municipal Act, 1922 (Bihar & Orissa Act VII of 1922), shall expire on such date or dates not later than one year after the commencement of this Act, as the State Government shall determine, and the State Government shall make appointments and cause a register of voters to be prepared by the Magistrate of the district, and arrangements of Election to be made under this Act so that the newly elected Councillors of the municipality may come into office on the date fixed for the retirement of the former Councillors of Commissioner, as the case may be: Provided that the Chairperson and the Vice-Chairperson of municipalities elected or appointed under the Bihar and Orissa Municipal Act, 1922 or under the Madras District Municipalities Act, 1920 shall continue in office until a new Chairperson and Vice-Chairperson have been elected or appointed under this Act and shall then vacate office.
