Proprietor not to be declared disqualified unless on ground of public interests.- The State Government shall not declare any proprietor to be disqualified under Clauses,(d), (e) and (f) of Section 10 unless satisfied that it is expedient in the public interest that his property should be managed by the Court, and a statement to this effect shall be interested in the declaration made by the State Government under Section 16. Provision to meet case of undivided Hindu families and co-sharers.- (1) The State Government shall not order the Court to take the property of an undivided Hindu family under its superintendence unless all the co-parceners are, declared to be disqualified under Section 10. (2) When two or more proprietors are co-sharers otherwise than as co- parceners in an undivided Hindu family and one of such co-sharers is, or is declared to be, disqualified under Section 10, the State Government may order the Court to institute a suit for partition on behalf of the disqualified proprietor and to take under its superintendence the property allotted to such proprietor in the partition.
