[2] Provisions of S.40 shows that an office bearer of the Panchayat can be removed on two conditions, i.e. either he is found guilty ofmisconductin discharging of his duties or his continuance in office is undesirable in the interest of the public. But where no such conditions was established and it was not a case of gross negligence therefore the Addl. Commr. rightly set aside the order of removal in revision. Kishore v.
