Where a provision is made in a concession agreement requiring the concessionaire to operate and maintain the transport facility constructed by him for a period as specified in such agreement, there shall be opened an escrow account by the concessionaire and the moneys shall be expended for the maintenance of the transport facility only in accordance with the provision in the concession agreement or in any other agreement.
