Section 58

Delivery of possession.--

(1) Where, notwithstanding such publication, any lawful purchaser of immovable property is resisted and prevented from obtaining possession of the immovable property purchased by him, the Collector, on application and production of the certificate of sale referred to in sub-section (1) of Section 56 duly registered as provided for in sub-section (2) of Section 57, shall cause the proper process to be issued for the purpose of putting such purchaser in possession in the same manner as if the immovable property had been decreed to the purchaser by a decision of a Civil Court: Provided that no application for putting the purchaser in possession of the immovable property shall be entertained by the Collector if such application is not made within one year from the date of confirmation of the sale: Provided further that the Collector may entertain any such application made within two years from the date of confirmation of the sale if he is satisfied that the applicant had sufficient cause for not making the application within the said period of one year. (2) For the purposes of this section, the Collector may exercise all the powers of a Civil Court under the Code of Civil Procedure, 1908 (Central Act 5 of 1908).
