[(1) The Government may, by notification and subject to such conditions as they think fit, exempt members the armed forces of the Union or of any other armed forces raised or maintained by the Union or attached to or operating with any of its armed forces and the members of the medical or other staff attached to any of the forces aforesaid or any foreign tourist from all or any of the provisions of this Act. Explanation.- For the purposes of this sub-section 'foreign tourist' means any person who is not a citizen of India and who stays in India for more than twenty four hours and less than six months for any non-immigrant purpose.] (2) When issuing a notification under sub-section (1) [State Government] shall have power to provide that a breach of any of the conditions subject to which the exemption is notified shall be punished with imprisonment which may extend to six months or with fine which may extend to one thousand rupees or with both.
