Section 219S

Prohibition of depositing of waste or rubbish or excreta in water bodies and water sources.--

(1) No person shall throw or deposit waste, rubbish or excreta in a water course, water body or water source or allow or cause to flow water from any latrine or allow waste water to flow in to it, or pollute the water in any other way, or engage, depute, compel, or instigate any person to do such activity. (2) An offence under sub-section (1) shall be cognizable and non-bailable. (3) Whoever commits an offence referred to in sub-section (1), shall, on conviction, be punishable with fine which shall not be less than ten thousand rupees but not exceeding fifty thousand rupees and with imprisonment for a term which shall not be less than six months but not exceeding one year.] Substituted by ACT 5 OF 2024 published in K.G.Ext. Prior to the Substitution it read as "Prohibition of deposit of rubbish or filth or excreta in water bodies and water sources.-- (1) No person shall deposit rubbish or filth or excreta in a public water course or water body or any such water source vested in the Village Panchayat under sub-section (1) of section 218 or allow to flow waste water into it or pollute the water in any other way engage or depute or compel or instigate any person to do such activity. (2) An offence under sub-section (1) shall be cognizable and non-bailable. (3) Whoever commits an offence referred to in sub-section (1), shall, on conviction, be punishable with fine which shall not be less than ten thousand rupees but not exceeding twenty five thousand rupees and with imprisonment for a term which shall not be less than six months but not exceeding one year."
