Constitutzon of Lmd Board.-(!) The Government shall con- stitute a Land Board for the whole State for performing the functions of the Land Board under this Act. The Board •hall consist of a sole member, who shall be the Head of the Land Revenue Department, or of three members. (2) Where the Board consists of three members, the members shall be- · (i) the Head of the Land Revenue Department who shall be the Chairman; (zt) a judicial officer not below the rank of a District Judge nominated by the Government in consultation With the High Court; (in) an officer of the Government nominated by the Government. (3) (a) The functions of the Board, where it consists of three members, may be exercised by a Bench consisting of all the members of the Board or by a Bench cons1stmg of two members constituted by the Chairman or, in the event of the office of a member other than the Chairman being vacant, by a Bench consisting of the Chairman and the other member. I ~) I 61 (b) Where any matter is heard by a Benc.h consisting of all the three members of the Board and the members d1ffer in opimon on any point, the point shall be decided in accordance with the opmion of the majority. (c) Where any matter is heard by a Bench consisting of two memhf'rs and the members are divided in their cpinion on any point, they shall state the pomt upon which they differ and the matter shall then be heard upon that point only by the third member and such point shall be decided according to the opimon of the third member.
