Unless the context otherwise requires:- (a) "Worker" means a person employed whether directly or indirectly or by himself through ownership of the vehicles, in a professional capacity, for the plying of the Autorickshaws, or Autorickshaw goods carriers for the purpose of transporting passengers or goods. (b) "Scheme" means the Kerala Autorickshaw Workers' Welfare Fund Scheme. (c) "Government" means the Government of Kerala. (d) "Member" means any worker enrolled under this scheme. (e) "Fund" means Kerala Autorickshaw Workers' Welfare Fund constituted under para 6(2) of the Kerala Autorickshaw Workers' Welfare Fund Scheme. (f) "Chief Executive Officer" means Chief Executive Officer of the Kerala Motor Transport Workers' Welfare Fund Board. (g) "Calendar year" means the year commencing on the first day of January. (h) "Financial Year" means the year commencing on the first day of April. (i) "Director" means a director of the Kerala Motor Transport Workers* Welfare Fund Board constituted under Section 6 of the Kerala Motor Transport Workers' Welfare Fund Act, 1985. (j) ["Family" means in the case of the member of this fund his or her spouse, children whether married, or unmarried, dependant parents and the widow and children of a deceased son of the worker]: Provided that if a member [of this fund] proves that his wife has ceased to be entitled to maintenance, she shall no longer, be a part of the member's family for the purpose of this scheme unless the member [of this fund] subsequently intimates by express notice in writing to the Chief Executive Officer that she shall continue to be so regarded: Provided further that if the child of a member [of this fund] has been adopted by another person and if under the personal law of the adopter, the adoption is legally recognised, such child shall be considered as excluded from the family of the member [of this fund]. (k) "Other Officers and Staff" means the Officers and Staff appointed under sub-section (i) of Section 7 of the Kerala Motor Transport Workers' Welfare Fund Act, 1985. (1) "Register" means a register in which the names of the Workers are registered as a member. (m) "State" means the State of Kerala. (n) [Superannuation" means "when the member of the fund reaches the age of fifty (50) or on completion of thirty (30) years membership and subscription in the Scheme, whichever is earlier.] (o) "Form" means form appended to this scheme. (p) ["Autorickshaw Owner" means any person who shall be the registered owner of an Autorickshaw or Autorickshaw goods carrier other than those registered for private use.] (q) The words 'he' and 'his' shall mean as 'she' and 'her' also, respectively. (2) All other words and expressions used in this scheme but not defined shall have the meaning respectively assigned to them in the Kerala Motor Transport Workers' Welfare Fund Act, 1985.
