Cognizance of offence

Cognizance of offence. - No Magistrate shall take cognizance of an offence punishable under the Act, except- (a) upon a report in writing of the facts constituting such offences made by a Police Officer not below the rank of Deputy Superintendent of Police; or (b) upon information received from any person other than a police, or from any gazetted officer that such offence has been committed.
