No brick kilns shall be established on any land which–– (a) is agricultural land ; (b) is fit for cultivation of any agricultural produce ; (c) has not been declared as 2 [Gair Mujruba (Uncultivable land) as recorded in last jamabandi] in the Revenue records ; or (d) is within the demarcated forest area of the * State under 3 [the Indian Forest Act, 1927(16 of 1927)].
