No confidence motion against the Chairman of the Committee.- (1) A motion of no confidence may be moved against the Chairman at a meeting specially convened for the purpose under sub-section (2) and if the motion is passed by a majority of not less than two third of the members of the Committee, he shall cease to be the Chairman of the Committee. (2) For the purpose of sub-section (1) a meeting of the Committee shall be held within thirty days of the date of receipt of the notice of motion of no confidence. (3) The Chairman shall not preside over the meeting, but such meeting shall be presided over by such officer of the State Government as may be authorized by it, however, the Chairman shall have the right to speak and otherwise to take part in the proceedings of the meeting. AGRICULTURAL AND HORTICULTURAL PRODUCE MARKETING (DEVELOPMENT AND REGULATION) ACT, 2005 22 (4) If the motion of no confidence is failed or if the meeting could not be held for want of quorum, no notice of any subsequent motion of no confidence against the same Chairman shall be made until the expiry of period of six months from the date of such scheduled meeting.
