Whenever the Superintendent considers it necessary (with reference either to the state of the prison or the character of the prisoner) for the safe custody of prisoners that they should be confined by the use of instruments of restraint, he may, subject to the sanction of District and Sessions Judge, so confine them: Provided that in emergent cases, any prisoner may be confined by the use of instruments of restraint under the orders of the Superintendent in anticipation of sanction for a period not exceeding forty- eight hours.
