(1) A prisoner with mental illness shall not be punished for any act committed by him, but such restraints may be imposed as are necessary to prevent him from injuring himself or others or causing inconvenience. (2) A person confined under section 335 of the Criminal Procedure Code, 1973 (Central Act 2 of 1974), when not actually mentally ill, shall be subjected to the same discipline as a convict sentenced to rigorous imprisonment, except that he shall not be made to labour. (3) A person who is confined under observation for being of unsound mind, if subsequently found sane, shall be liable to punishment for breach of prison discipline during observation period.
