No prisoner with mental illness shall be transferred from prison to a mental health establishment, unless :- (a) the Medical Officer certifies, immediately before his dispatch, that he is physically fit to undertake the journey; and (b) it has first been ascertained that the Medical Officer in charge of the mental health establishment, where the prisoner is being transferred, is prepared to receive him. NOTE.- While certifying the fitness for transfer of any prisoner with mental illness, the Medical Officer shall carefully examine the existence of any disability exhibited by or injury marks on the person of, such prisoner.
