(1) On receipt of an order from the Government or Mental Health Review Board, for the removal of a prisoner with mental illness to a mental health establishment, the Superintendent shall transfer the prisoner to the mental health establishment, along with the following documents, namely :- (a) copy of the order of the Government or Mental Health Review Board directing his transfer; (b) descriptive-roll of the prisoner; (c) copy of the Medical Certificate from the Board of Doctors; (d) history ticket and private property (if any) and addresses of prisoner’s relatives and friends; (e) warrant of commitment to prison, (if a convict) indicating term of sentence, date of admission to the prison and probable date of release of the prisoner; (f) remission,if any, earned while in prison; (g) copy of the court’s judgment in case of a convict; and (h) details of under-trial cases. NOTE.- A copy each of the above documents shall be retained in the prison record. (2) The Superintendent, while sending such a prisoner to a mental health establishment for treatment or observation, shall requisition police guard to escort the prisoner to the mental health establishment. (EXTRA.), DEC. 30, 2022 (PAUS. 9, 1944 SAKA) 1291 (3) Information regarding transfer of a prisoner with mental illness shall be sent to the court concerned, local police and family of the prisoner. (4) Every precaution shall be taken to ensure that the prisoner with mental illness is properly taken care of whilst in transit to the mental health establishment. Proper arrangements shall be made regarding his property, clothing, and food as prescribed in these rules relating to transfer of prisoners. Instruments of restraint shall not be used unless absolutely necessary. NOTE.- All Government property accompanying a prisoner with mental illness on transfer to a mental health establishment shallbe returned to the dispatching prison.
